In using this website you are deemed to have read and agreed to the following terms and conditions: The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", "You" and "Your" refers to you, the person accessing this website and accepting the Company s terms and conditions. "The Company", "Ourselves", "We" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services/products, in accordance with and subject to, prevailing English Law. Payment:

We do not accept cash or checks. All major Credit/Debit Cards are all acceptable methods of payment. Our Terms are payment in full within the date of purchase unless you are receiving a quote from the company. Cancellation Policy: Minimum 24 hours notice of cancellation required. Notification for instance, in person, via email, mobile phone ‘text message’ and/or fax, or any other means will be accepted subject to confirmation in writing. We reserve the right to levy a $30 charge to cover any subsequent administrative expenses.

Termination of Agreements and Refunds Policy:

IDigitize has the right to cancel/terminate any service(s) that have begun for any reason. No refunds shall be offered, where a Service is deemed t have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused Services, shall be Refunded.

Log Files:

We use IP addresses to analyze trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission. This company is registered in New Jersey under the LLC of Mayo Video LLC with the fictitious name of iDigitize. This company operates in New York.

While using this service you agree not to:

(1)Spam or flood the website.
(2) Violate Copy Written Laws
(3) Modify/Change the service.
(4) Collect information about other users or hack into systems
(5) Abuse or Harass workers of iDigitize.

Submission of content:

You may not submit any threatening, pornographic, or copy written material that would infringe on intellectual property rights. Any Material sent from a false address. You warrant that all moral rights in any Submissions and uploaded materials have been waived and do hereby waive any such moral rights. You indemnify iDigitize for any cost, legal action, or damages to do with copy written, pornographic, or threatening material.

Shipping:

iDigitize is not liable for any is not liable for the any Submissions or other materials while in transit through or in possession of the United States Postal Service, United Parcel Service, Federal Express or any other carrier. While you remain liable for any misdirected, lost, stolen or damaged materials while in transit with the carrier.

Indemnification:

You agree to indemnify, defend and hold us, our officers, directors, employees, agents, licensors, suppliers and any third-party information providers to the Service harmless from and against all claims, liabilities, losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from (i) any violation of these Terms, or any activity related to access to or use of your account (including negligent or wrongful conduct) by you or any other person accessing the Service using your account (ii) any images, video or other content you post to the website o submit through the Service; and/or (iii) a claim that a Submission infringes third party intellectual property rights.

Pickup and Delivery:

iDigitze offers free pickup as well as delivery only in Manhattan and only from 12th avenue through 8th avenue, Streets 33rd through 55th All other pickup and deliveries will cost 10.00 each way unless the order exceeds $75. All deliveries if paid for shall be paid through an online payment. We reserve the right to charge up to $30.00 for absent pickup and deliveries regardless of if you are in our free range.

Drop Off:

All clients may drop off and pick up at our seven locations. All clients agree to fill out a drop off form prior to making the drop off. iDigitize is not responsible for lost or stolen items from the time of drop off to the time the job is completed. iDigitize has never lost a client’s content, period. iDigitize has partnered with local neighborhood “UPS Store” locations for the clients convenience. The UPS Store is in no way responsible for the acts of iDigitze whatsoever. The client can choose any UPS Store location that is listed on our website idigiitze.com, google.com. yelp.com and any other listing site. The listing must read “iDigitize Video Transfer @ UPS” with the local UPS Store number included. If a client chooses to drop off with our UPS Store location, they must pickup from that same location unless otherwise specified in an email to deliveries@idigitize.com The client agrees to fill out the form at The UPS Store fully and entirely.

Re-transfers:

In the rare instance that iDigitize has made a mistake or the client believes the quality is less of that which is on the original tape, the client may request a re-transfer. If iDigitize cannot perform a re-transfer then the client may ask for a refund. However, the client must provide the original tape along with the original transfer that iDigitize had performed. If we cannot find fault in the original transfer, we reserve the right to send you back the tape having the client take care of return cost

Satisfaction Guarantee:

If the client is not satisfied with the service and it meets the terms stated above, we will offer the client a full refund within 30 days of the client’s request. The client reserve the right to be un-satisfied if and only if his or her tape was not transferred, damaged, lost, stolen. If his or her photos were not scanned, damaged, lost, or stolen. The client must have substantial proof to make an accurate claim.

These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of his website and/or undertaking of a booking or Agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.
